Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, website, and CRM application provided by Buzz Boom Creative ("Buzz Boom," "we," "us," or "our") at bzzbm.co and related domains (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Introduction

Welcome to Buzz Boom Creative! We provide creative marketing services, tools, and a customer relationship management (CRM) application designed to help businesses manage marketing campaigns, client relationships, analytics, and related features.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Accounts and Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Subscription and Service Terms

  • The Service is provided on a subscription basis (monthly or as specified).
  • Subscriptions automatically renew at the end of each term unless canceled.
  • Payments are due in advance of the service period.
  • We may change pricing with notice (changes apply at the next renewal).

5. Billing and Payment

  • You authorize us to charge your chosen payment method for all fees.
  • All fees are non-refundable except as expressly stated.
  • Late payments may incur interest or result in suspension of the Service.
  • Any additional customer-approved billable hours or services will be invoiced in the following billing cycle.

6. Cancellations and Refunds

  • No Refunds: All payments are non-refundable.
  • You may cancel your subscription at any time, effective at the end of the current billing period.
  • Cancellations must be made before the renewal date to avoid charges for the next period.
  • To cancel, use the account cancellation feature in your account subscriptions page.

7. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

  • Use the Service in any way that violates laws or regulations.
  • Interfere with or disrupt the Service or servers.
  • Attempt to gain unauthorized access to any portion of the Service.
  • Upload or transmit viruses or malicious code.
  • Use automated means (e.g., bots, scrapers) to access the Service without permission.

We may suspend or terminate your access if you violate these Terms.

8. Intellectual Property

  • We own or license all rights, title, and interest in the Service, including all content, features, and functionality.
  • You retain ownership of your content uploaded to the Service ("User Content").
  • You grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content as necessary to provide the Service, subject to Section 16.
  • You are responsible for ensuring your User Content does not infringe third-party rights.

9. Data and Privacy

Your use of personal data is governed by our Privacy Policy at https://bzzbm.co/privacy-policy, which is incorporated into these Terms.

10. Termination

  • You may terminate your account at any time.
  • We may terminate or suspend your access immediately, without notice, for any reason, including breach of these Terms.
  • Upon termination, your right to use the Service ceases. Sections that by nature survive termination (e.g., payment obligations, intellectual property, liability) will continue.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUZZ BOOM CREATIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Buzz Boom Creative, its affiliates, and personnel from any claims, losses, or damages arising from your use of the Service, your User Content, or your violation of these Terms.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via the Service or email. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles. Any disputes shall be resolved in the courts of King County, Washington.

16. Use of Artificial Intelligence

16.1 How we use AI. We use artificial intelligence ("AI") tools to help with drafting, design, development, research, and analytics, and some features of the Service (such as AI chat agents) run on third-party AI providers. AI is a tool in our process. It does not replace our judgment.

16.2 Disclosure. We note in each project record where AI tools were materially used to create your deliverables, and we will answer any question about our AI use on request.

16.3 Human review. A member of our team reviews deliverables created with AI assistance before we deliver or publish them. Automated, real-time AI features you enable (such as an AI chat agent on your website) generate responses without human review of each response. These features are identified as AI, and you are responsible for configuring and monitoring them.

16.4 Your choices. You may ask us in writing not to use AI tools for any part of your project, and we will honor that request. Some plans include AI features as a required, core part of the service, as described on the applicable plan or order page. To opt out of those features, you will need to choose a plan that does not include them, which may be priced differently. Opting out may also affect project timelines.

16.5 Your business information. We will not enter your confidential business information into third-party AI tools without your consent, which you may give at onboarding or project by project. This does not apply to data processed by AI features you choose to enable, such as visitor messages handled by an AI chat agent, which are processed by our AI providers as described in our Privacy Policy.

16.6 Limits of AI output. AI-generated content can be inaccurate or incomplete. Section 11 (Disclaimer of Warranties) applies to AI features and AI-assisted content. You should review content before relying on it.

16.7 Changes. We will make reasonable efforts to notify you in advance of material changes to how we use AI or how our AI providers handle your data.
